An Accra High Court has thrown out a case brought before it by the independent presidential candidate for the 2016 elections, Jacob Osei Yeboah (JOY) against the Electoral Commission (EC) over the credibility of the register of voters.
Mr Osei Yeboah sued the election management body following what he calls the failure of the EC to clean the electoral roll.
In a letter to the EC dated June 14, 2016 and signed by his lawyer, Mr Peter Kweku Nti, the presidential candidate asked the EC to amend the provisions of CI 91, which deals with exhibition of the electoral register, “so as to be able to delete technically and legally in order to implement the order of the Supreme Court to create a reasonably credible biometric voters register.”
He also asked the EC to employ biometric technology to enable it to practically follow the orders of the Supreme Court in respect of the cleaning of the register before the December 7 polls.
JOY further challenged the EC to strictly enforce the Political Parties Law (Act 574), claiming that compliance with Act 574 was a requirement under the 1992 Constitution and, therefore, any violation of the law was unconstitutional.
But the High Court presided over by Justice Gifty Adjei Addo, on Monday, October 31, dismissed the case against the EC.
The court is, however, set to release the reason for the dismissal on Tuesday, November 1, 2016.
