Election 2016 Konadu heads to court Friday

The action by the party comes on the back of the EC’s call asking it to go to court if it wished.

The National Democratic Party (NDP) has said it will head to court tomorrow, Friday, 14 October to file a suit against the Electoral Commission for disqualifying its flag bearer Nana Konadu Agyeman-Rawlings from the December 7 polls.

"We'll definitely head for court … It's a dangerous development," Alhaji Muhammed Frimpong, General Secretary of the party told Accra-based Class FM on Thursday.

The action by the party comes on the back of the EC’s call asking it to go to court if it wished.

The 11-page response to a letter by lawyers of the NDP leader who threatened a court action against the Commission if their client is not reinstated, said: “Our reading of the rules regulating the presidential elections confirms that the submission of nomination papers for the purpose of contesting the presidential elections confirms that the submission of the forms does not result in the automatic acceptance of such forms by our client.”

"Having taken that decision as required by regulation 9(4) of C.I 94 which spells out the procedure for dealing with the matter, our client finds no legal basis to rescind its decision especially that the statutory provisions upon which your letter is grounded do not allow our client such discretion.

"We do not doubt your clients' resolve to pursue their cause to the ends afforded her by the law but we trust that your client will, as dutiful citizens of the Republic of Ghana, support our client’s constitutional mandate and efforts to deliver free, fair and credible elections,” the statement added.

The EC on Monday announced the disqualification of 12 candidates including The Peoples National Convention’s (PNC), the Progressive Peoples Party (PPP)’s the All Peoples Congress, and the National Democratic Party (NDP)’s for failing to meet the criteria for filing as president. 

Nana Konadu was in 2012 disqualified by the Electoral Commission from contesting in the presidential elections over her inability to appropriately fill her nomination forms.
