Transition team cannot bequeath residence to Mahama - Ace Ankomah

Ace Ankomah explained that the transition teams of both President Nana Addo and former president Mahama cannot reach such an agreement that will bind the Republic.

In a Facebook post on his timeline, Ankomah explained that the transition teams of both President Nana Addo and former president Mahama cannot reach such agreements that will bind the Republic.

“There could not have been any agreement on the sale of what has become the VP's official residence, to anybody prior to the new president being sworn-in. I don't even want to believe that the NPP portion of the transition team dared to agree to such a request.”

“The 19th December 2016 alleged letter from the then Chief of Staff was at best a mere request. (It does not even appear to have an addressee, but I digress.) It didn't constitute an agreement. No one in the NPP side of the transition team had the power to enter into any binding agreement on behalf of the people of Ghana. They are not persons who can bind the Republic to any agreements. See section 20 of CA6.”

He further said that even if the transition teams agreed to such a request, it will not bind the State because they do not have the legal mandate to reach such agreements.

“But let's assume they 'agreed'. Any such 'agreement' would be nullified on account of the lack of statutory capacity of the persons allegedly entering into it. At best that 'agreement' will require the ratification of the new government after the swearing-in, or an entirely new agreement; and I say this because I have seen "nullities" ratified by Parliament. But again, I digress.”

“I am waiting to see if the new government would dare do something like this. Then we will inquire into what illegal and bad stuff they are smoking on Day One.”

Former President John Mahama has asked for the official Vice Presidential bungalow to be allocated to him as part of his ex-gratia.

The bungalow, located at Cantonment, housed Professor John Evans Atta while he was serving as Vice President under Jerry John Rawlings and Aliu Mahama, who also served as Vice President under John Agyekum Kufuor.

John Mahama first occupied the building in 2009 when he served as Vice President before becoming President.

Even as President, the bungalow became his official residence although he has a home as a President inside the Flagstaff House.

In addition, the former president is demanding for Bungalow No.6, 3rd Avenue, Ridge, Accra as his office.
