Special Prosecutor will operate without constitutional hindrances – Godfred Dame

According to President Nana Addo Dankwa Akufo-Addo, the Independent Prosecutor’s Office will be one of the measures his administration will implement to fight corruption in the public sector.

The Deputy Attorney General Godfred Dame has indicated that the office of the Special Prosecutor will not encounter any constitutional challenges when it is set up.

He was answering questions when he appeared before the Appointments Committee to be vetted on Wednesday (March 29, 2017).

However, Minority in Parliament earlier argued that the proposed corruption fighting portfolio breaches the constitution of the state.

The Minority Leader Haruna Iddrisu argued that an office that is not stipulated by the Constitution will conflict with the provisions of Article 88 of the Constitution which vests the functions of the proposed Independent Prosecutor’s Office in the Attorney-General.

Haruna Iddrisu also added that the Minority may head to court to challenge the institution of an Independent Prosecutor’s Office.

But Mr Dame believes that will not be necessary since the office will not conflict with any constitutional provision.
