Lawyers for Jihad Chabaan, the Lebanese manager of Marwako facing trial for assaulting an employee, have said they will file a submission of ‘no case’ although a prima facie case has been made against Chabaan.
Earlier, the court, presided over by Ms Victoria Ghansah rejected an out of court settlement application by lawyers of the defence.
The move to file a submission of 'no case' follows the completion of cross-examination of the case investigator, Detective Inspector Eunice Ashiagbor.
The defence lawyers had prayed the court for a recall of the victim into the witness box to cross-examine her on new evidence they have found.
According to the lawyers for Chabaan, they were of the belief that justice will be fairly served if given the opportunity, as the new the new evidence they had could change the course of the case.
The application was opposed by the prosecution who argued the defence have had ample opportunities to cross-examine the victim.
The judge delivering her ruling dismissed the application by the defence and warned them to stop using frivolous applications as means of delaying the case.
Jihad Chaaban dipped the face of a kitchen staffer Evelyn Boakye at the Abelemkpe branch of the eatery into pepper paste.
This inhumane treatment has caused many social media users in Ghana calling for the boycott of the eatery.
This has led to the creation of a hashtag #boycottMarwako. Meanwhile, management of the restaurant has suspended the supervisor until police conclude investigations into the matter
