CEO Of Silver Star Auto Limited, Kalmoni Nouhad, Jailed For 21 Days

Chief Executive Officer of Silver Star Auto Limited, Kalmoni Nouhad, has been jailed for 21 days for contempt by the Accra commercial court.

Kalmoni Nouhad was convicted on December 1, 2014 after his company failed to obey the court’s orders to deliver a brand new Mercedes Benz to the plaintiff, the former Director of Ghana School of Law, G. A. Sarpong on July 10, 2014.

The court, presided over by Mr Justice G. Koomson, deferred its sentencing and reasons to yesterday which held the convict for failing to obey the court’s order after he had been given an undertaken to obey the directives of the court.

Mr. Sarpong filed in a civil action against Silver Star Auto Limited in 2009 after he had purchased a brand new Mercedes Benz car which broke down the same year. The High Court, which heard the matter, ordered the automobile company to replace the vehicle because the time-span fell within the warranty period. Not satisfied, Silver Star Auto Limited appealed against the decision at the Court of Appeal and succeeded in getting the court to review the high court’s decision by ordering the car dealer to only replace the damaged engine and not the whole car.

Dissatisfied with the court’s decision, G. A. Sarpong went to the Supreme Court and succeeded in overturning the decision of the Court of Appeal. The highest court of the land, in January 2014, held that the plaintiff was entitled to a replacement of the defective vehicle with a brand new one. However the defendant fail to obey the highest court ruling after Counsel for the plaintiff, Mr Joseph Opoku Boateng, filed the necessary legal documents at the High Court and sought to enforce the Supreme Court decision.
