Mr. Richard Sky has dragged President John Mahama to the Supreme Court to seek interpretation as to who should appoint the next EC boss
The legal team for Ghanaian journalist Richard Dela Sky journalist Richard Sky have given an indication they will file an application for contempt against the Attorney General for the president's appointment of a new Electoral Commission boss while a similar case is pending before the court.
According to the lawyers the action of the president by announcing and swearing in a new EC chair Charlotte Osei amounted to a total disregard of the authority of the court hence their decision to take action against the AG.
Mr. sky is before the court to seek interpretation of provisions of the 1992 Constitution on the appointment of an Electoral Commission (EC).
The Supreme Court on Tuesday adjourned the case sine die to allow lawyers for Mr. Sky and another applicant Dr. Danso Acheampong who is seeking the same relieves as Him the court on formally file an application for consolidation of their case to that of the GBA and three others against the Attorney General and the Judicial Council, which is on the proper mode of appointments to the Supreme Court bench.
Meanwhile, the seven member panel of the Supreme court presided over by the Chief Justice, Georgina Theodora Wood adjourned the case “sine die” [indefinitely] to allow lawyers for Mr. Sky and another applicant Dr. Danso Acheampong who is also before the court on the same issue to formally file an application for consolidation of their case to that of the Ghana Bar Association (GBA) and three others against the Attorney General and the Judicial Council, which is on the proper mode of appointments to the Supreme Court bench.
The justices of the Supreme Court were of the view that the intervening suit by the GBA was more “comprehensive” and needed to be resolved first so it becomes the yardstick for the determination of the case of the EC boss appointment.
