It looks almost unprecedented how a 47-year old mason, Bismark Boi Tei narrowly escaped imprisonment after he was able to convince an Accra Circuit Court to strike out a defilement charge levelled against him.
He filed a submission of no case through his lawyer, Eric Opoku Brobbey and the court presided over by Mrs Abena Oppong Adjin Doku discharged and acquitted him.
He pleaded not guilty to the charge of defilement. His lawyers noted after the close of the case of the prosecution that no case had been made against him and for that reason filed a submission of no case.

Prosecuting Chief Inspector Kofi Atimbire narrated to the court that the victim was the granddaughter of the complainant who is a trader and they both live in the complainant’s residence at Pantang Village.
The accused also resides at Aboman, near Adenta. During the month of June last year, Bismark Boi Tei allegedly had sex with the victim on the floor in front of the victim’s school premises.
According to the prosecutor, one Madam Rebecca Otchere, a friend to the complainant detected some obscene smell on the victim and questioned her.

The prosecution said the victim narrated her ordeal to Madam Otchere and she also informed the complainant who subsequently lodged a complaint with the police.
As usual, the police issued the class three pupil with a medical form to seek medical attention and Tei was subsequently arrested.
It is very rare for a man accused of defilement and other sexual offences, especially those allegedly committed against children to evade imprisonment in Ghana.
