Suspects acquitted and discharged for inadequate evidence

Aside the failure of the prosecution to prove the charge against the accused persons beyond reasonable doubts, the court said there were inconsistencies in the evidence of the witnesses called before it.

An Accra Circuit Court has discharged and acquitted two persons who were accused of defiling a seven-year old girl at Adenta on different occasions.

The court presided over by Mrs. Abena Oppong Adjin-Doku held that the prosecution failed to prove its case beyond reasonable doubt against Frederick Owusu and Seth Awukuvi.

The court further added that, there were inconsistencies in the evidence of the witnesses called before it.

Owusu, 28, and Awukuvi, 24, both of whom walk free now, had been charged with the crime, and they had pleaded guilty.

Prosecuting, Inspector Judith Asante narrated to the Court that the complainant was a businesswoman with whom both the victim and the accused persons lived at Abladjei-Parka at Adenta.

According to her, on June 27, 2015, the complainant was bathing the victim and in the process of washing her vagina, she detected some sores there.

The victim then mentioned the accused persons as those who had defiled her, but warned her not tell anyone.

As stated by the prosecution, the victim claimed Owusu had sex with her anytime the complainant was absent.
