Court grants businessman accused of rape N200,000 bail

Nesiama, who gave no fixed address, is facing a two-count charge of a breach of the peace and rape.

Magistrate Omolade Awope also ruled that the accused should produce two sureties in like sum, one of whom should be a religious leader in Lagos State.

He said that the other surety must own a property within the court’s jurisdiction.

He said the sureties must also show evidence of three years’ tax payment to the Lagos State Government (LASG).

Earlier, the prosecutor, Insp. Ezekiel Ayorinde, had told the court that the accused committed the offences on March 9 at about 11.00 p.m. at Excel Hotel, Opebi in Ikeja, Lagos.

According to him, the accused raped the complainant (name withheld) through his anus without consent.

He said that the accused, under the pretext of helping the complainant who is a security guard in the same church he attends to secure a better job, had invited him over to the hotel.

“The complainant said that Nesiama had always shown concern about his welfare by asking how he was doing whenever he sees him in church and gives him money.

“He also promised to help the complaint in his bid to further his education.”

The prosecutor alleged that the complainant on getting to the hotel room; was asked to take off his clothes and immediately snapped him without his consent.

Ayorinde said that the accused threatened the complainant that if he refused to have sex with him, he will publish and show his nude pictures to their pastor and everyone.

“Out of fear of being sacked, l agreed to his threat and he had carnal sex with me through the anus.’’

Ayorinde said the accused was later apprehended by the police.

The prosecutor said the offences contravened Sections 166 and 259 of the Criminal Law of Lagos State, 2011.

The News Agency of Nigeria (NAN) reports that Section 259 prescribes life imprisonment for offenders.

The case was adjourned until April 26 for mention.
